By continuing to access or use this Website, you confirm that you have read, understood, and accepted these Terms, including our Privacy Policy[ 1] , Cookie Policy[ 2] , and any additional terms referenced herein or available via hyperlink (collectively referred to as the “Terms of Service”).

If you do not agree with any part of the Terms of Service, you must not use our Website or Services. Your continued use of the Website indicates your consent to these terms and to the lawful processing of your personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR), where relevant.

1. Definitions

The following definitions apply throughout these Terms of Service. Capitalised terms used herein shall have the meanings assigned to them below:

"AI Image Generation Technology" refers to the artificial intelligence-based system integrated into the Platform, which is used to produce digital artworks and visual content upon a user's input.

"Business Day" means any day other than a Saturday, Sunday, or public holiday in England and Wales on which banks and government institutions are generally open for business.

"Content" includes all material made available through the Platform, whether created by FantasiaFlows, licensed third parties, or other authorised contributors. This includes, but is not limited to, text, code, images, graphics, videos, sound files, logos, databases, icons, and trademarks.

"Intellectual Property" means all intellectual property rights (whether registered or unregistered), including copyrights, trademarks, patents, design rights, trade secrets, and similar rights recognised under applicable laws.

"Platform" refers to the Website and associated services made available via https://fantasiaflows.com, including all features, tools, technology and resources provided therein.

"Point(s)" means a service offering, which is the Platform’s internal, redeemable point system, where users can acquire and use the Points (including bundles, special offers and on-demand packages related to them) solely for access to the Platform services and/or to unlock the Platform’s features.

"Privacy Policy" refers to the document explaining how we collect, process, and safeguard personal data, available on our Website and incorporated by reference into these Terms of Service.

"User Account" means a personal, non-transferable account created for a user for the purpose of accessing and using the Platform's features and functionalities.

"AI-Generated Content" (AIGC) means any content (including but not limited to images, text, or other artwork or creative materials) that is AI-generated or otherwise created for users through the Platform.

2. Service Description

The Platform enables registered users to access and utilise proprietary AI Image Generation Technology, which facilitates the creation of digital artwork and visual content through artificial intelligence-based systems. Users may engage with a range of creative tools and features made available on the Platform to generate unique outputs based on their input parameters.

The services offered via the Platform are made available for informational, entertainment, and/or creative purposes only. All functionalities are provided "as-is" and may be updated, enhanced, restricted, or discontinued at the sole discretion of FantasiaFlows at any time, with or without prior notice.

We reserve the right to modify or restrict access to any aspect of the Platform, including but not limited to service features, pricing models, and technical specifications, in order to ensure compliance with legal obligations, internal policies, and applicable industry standards.

3. User Eligibility

To access and use the Platform, you must be at least 18 years of age or possess legal capacity under the laws of your jurisdiction. Individuals under the age of 18 may only use the Platform with the express consent and supervision of a parent or legal guardian.

Use of the Platform is not permitted in jurisdictions where such use would contravene applicable laws or regulatory restrictions. FantasiaFlows explicitly prohibits access to the Platform from the following jurisdictions and territories: Afghanistan, Albania, Algeria, Angola, Belarus, Bosnia and Herzegovina, Bulgaria, Burkina Faso, Burundi, Cameroon, Central African Republic, Chad, China, Croatia, Cuba, Democratic Republic of the Congo, Democratic People's Republic of Korea (North Korea), Ethiopia, Gabon, Guatemala, Guinea, Guinea-Bissau, Haiti, Iran, Iraq, Kenya, Kosovo, Laos, Lebanon, Liberia, Libya, Madagascar, Mali, Moldova, Monaco, Montenegro, Mozambique, Myanmar (Burma), Namibia, Nicaragua, Niger, Nigeria, Northern Cyprus, North Macedonia, Philippines, Republic of Congo, Russia, Senegal, Serbia, Sierra Leone, Somalia, South Africa, South Sudan, Sri Lanka, Sudan, Suriname, Syria, Tanzania, Tunisia, Venezuela, Vietnam, Yemen, Zimbabwe, as well as disputed or occupied territories including but not limited to Crimea, Donetsk and Luhansk. WE RESERVE THE RIGHT TO UPDATE THIS LIST AS NEEDED TO MAINTAIN COMPLEANCE WITH INTERNATIONAL LEGAL FRAMEWORKS AND OUR INTERNAL COMPLIANCE POLICY.

BY ACCESSING OR USING THE PLATFORM, YOU REPRESENT AND WARRANT THAT:

you meet the minimum age or legal capacity requirements;
you are not a resident or national of any prohibited jurisdiction;
your use of the Platform does not breach any applicable laws, regulations, or sanctions applicable to you or your country of residence.

4. User Account

In order to access certain functionalities or services offered via the Platform, you may be required to register and create a personal User Account. You are solely responsible for ensuring the security and confidentiality of your login credentials, and for all activities conducted through your User Account, whether authorised by you or not.

When creating a User Account, you must provide accurate, current, and complete information, including but not limited to your name, email address, and any other data requested in the registration form. You agree to promptly update your information in the event of any changes to maintain its accuracy and completeness.

Any provision of false, misleading, or incomplete information may result in immediate suspension or termination of your User Account and/or access to the Platform.

You agree to notify FantasiaFlows immediately via email at support@fantasiaflows.com if you become aware of or suspect any unauthorised use of your User Account or any other breach of security. We are not liable for any loss or damage resulting from your failure to maintain the confidentiality of your credentials.

FANTASIAFLOWS RESERVES THE RIGHT, IN ITS SOLE DISCRETION AND WITHOUT PRIOR NOTICE, TO SUSPEND, RESTRICT, OR TERMINATE YOUR USER ACCOUNT OR ACCESS TO THE PLATFORM IF:

you violate these Terms of Service or any applicable law or regulation;
your actions may cause legal liability for FantasiaFlows or other users;
we have reasonable grounds to believe you are involved in fraudulent, abusive, or otherwise suspicious activity.

5. Payment and Delivery Policy

5.1. Account Top-up: To access certain features or premium services on the Platform, users may top up their User Account with funds in exchange for Points, which are internal virtual units usable exclusively within the Platform. The exchange rate is 1 (one) Euro to 1 (one) Point. Points may be acquired through predefined packages or by selecting a custom amount during checkout.

5.2. Use of Points: Points are granted to the registered user on a non-exclusive, non-transferable, revocable basis and may only be redeemed for services and\or features made available on the Platform. Points have no monetary or cash value outside the Platform, are not legal tender, and may not be resold, exchanged, transferred, or redeemed for cash or credit. Once Points are recorded into your User Account, our obligations in relation to their delivery are considered fulfilled.

5.3. Pricing and Payment Methods: All pricing for top-ups and services is available on the Platform and may be modified from time to time. Prices include applicable taxes unless otherwise stated. We accept payments via major credit or debit cards, including VISA and Mastercard. By submitting payment information, you confirm that you are authorised to use the chosen method of payment.

5.4. Refunds: Top-ups converted into Points are non-refundable, except where:

You experience a technical issue that prevents access to a purchased service and it cannot be resolved within 5 (five) Business Days of notifying support;
Unauthorised charges are detected and confirmed upon investigation;
A billing error has occurred (e.g., overcharge), evidenced by the user;
FantasiaFlows, at its sole discretion, determines a refund is necessary to prevent misuse or fraudulent activity.

Users located in the European Economic Area (EEA), the United Kingdom, or Switzerland have the statutory right to withdraw from their order when purchasing our services (e.g. Points, packages or bundles related to them) within 14 days, without providing a reason, provided the Points have not yet been used. To exercise this right, users must notify FantasiaFlows in writing via email at support@fantasiaflows.com. In such cases, we will issue a refund within 14 days from the refund request date, using the original payment method unless otherwise agreed.

5.5. Taxes and Fees: Users are solely responsible for any additional fees, charges, or taxes levied by financial institutions, card issuers, or government authorities in connection with their use of the Platform.

5.6. Third-Party Payment Processors: FantasiaFlows may engage third-party payment providers to facilitate transactions. Use of such providers is subject to their terms and conditions. FantasiaFlows assumes no responsibility for the acts or omissions of such third parties.

5.7. Delivery of Services: Upon successful payment and confirmation, Points will be immediately recorded into your User Account. Services that require creation of deliverables (e.g., AIGC) will be fulfilled and made available within 2 (two) Business Days unless otherwise stated. Any delays will be communicated via your registered contact details.

5.8. Order Cancellation: Orders may be cancelled freely prior to payment. For cancellations following payment, users must refer to the Refunds section above.

6. Intellectual Property Rights

6.1. Ownership of Intellectual Property: All Content, features, and functionality provided on or through the Platform (excluding AIGC), including but not limited to source code, algorithms, interfaces, website design, software, images, text, graphics, logos, audio clips, video content, and other materials, are the exclusive property of FantasiaFlows or its licensors and are protected under applicable intellectual property laws, including but not limited to copyright, trademark, and patent laws.

6.2. Use Restrictions: You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and related services strictly in accordance with these Terms of Service. You may not copy, reproduce, distribute, modify, reverse engineer, decompile, disassemble, publish, or create derivative works from any part of the Platform or its Content without FantasiaFlows’s prior written consent.

6.3. Company Trademarks: The names, logos, service marks, trade names, product names, and other distinctive brand features displayed on the Platform are registered and unregistered trademarks of FantasiaFlows or third parties. You may not use these without express prior written consent of the respective owner.

6.4. Respect for Third-Party Rights: FantasiaFlows respects the intellectual property rights of others and expects all users of the Platform to do the same. You agree not to upload, publish, or otherwise distribute any content that infringes the rights of third parties, including copyright, trademark, or other proprietary rights.

6.5. Claims of Infringement: If you believe that your intellectual property rights have been infringed upon by content hosted on the Platform, you may notify us by email at support@fantasiaflows.com. Your notice must include:

A description of the work you claim has been infringed;
A description of the infringing material and where it is located on the Platform;
Your name, address, telephone number, and email;
A statement that you have a good faith belief the disputed use is not authorised by the intellectual property owner, its agent, or the law;
A statement, under penalty of perjury, that the information provided is accurate and that you are the owner or are authorised to act on behalf of the owner.

FantasiaFlows will promptly investigate all such claims and, if appropriate, remove the infringing content or restrict access to it in accordance with applicable laws and platform procedures.

7. AI-Generated Content

7.1. Ownership and Rights: By using the Platform, you may generate, submit or create content, including artwork, images, visuals, text, or other materials (AIGC). Subject to your compliance with these Terms of Service, you retain full ownership and intellectual property rights in and to your AIGC.

7.2. Licence to FantasiaFlows: By submitting or uploading your initial content or inputs, and by generating AIGC on or through the Platform, you grant FantasiaFlows a non-exclusive, worldwide, royalty-free, transferable, and sublicensable licence to use, host, store, reproduce, modify, adapt, communicate, publish, publicly display and distribute such content/inputs/AIGC solely for the purpose of providing and improving the Platform and related services, including customer support, security, and promotional operations (where applicable).

7.3. Your Responsibilities: You are solely responsible for the content/inputs/AIGC you create, upload, or otherwise make available via the Platform. You represent and warrant that:

You own or have obtained all necessary licences, rights, consents, and permissions to use and to authorise FantasiaFlows to use such content;
Your content does not infringe upon any third-party intellectual property, privacy, or publicity rights;
Your content complies with all applicable laws and regulations and does not contain unlawful, offensive, defamatory, or harmful materials.

7.4. Content Moderation and Removal: FantasiaFlows does not actively monitor inputs/AIGC but reserves the right (without any obligation) to review, remove, or disable access to any content that:

Violates these Terms of Service;
Is alleged to infringe the rights of third parties; or
Is otherwise unlawful, harmful, or inappropriate.

7.5. No Liability for User Content: FantasiaFlows does not endorse any AIGC, nor does it assume any liability for content uploaded, generated, or shared by users. Users acknowledge that they use or rely on any AIGC at their own risk.

7.6. Content Backups: You are solely responsible for backing up your own content. FantasiaFlows does not guarantee that AIGC will be preserved or retrievable indefinitely and shall not be liable for any loss or deletion of such content.

8. Prohibited Conduct

8.1. General Prohibitions: By using the Platform, you agree not to engage in any activities that could harm, disrupt, or negatively impact the Platform or other users. Specifically, you must not:

Violate any applicable local, state, national, or international law, regulation, or order while using the Platform;
Infringe upon the rights of other users, FantasiaFlows, or third parties, including intellectual property rights, privacy rights, and contractual rights;
Engage in any fraudulent, deceptive, or misleading activities, including the provision of false or misleading information;
Upload, post, transmit, or otherwise make available any content that is defamatory, obscene, libellous, harmful, harassing, or otherwise unlawful or inappropriate;
Impersonate any person or entity or falsely represent your affiliation with any person or entity, including FantasiaFlows or any of its representatives;
Engage in or facilitate any activity that could harm, overload, or impair the functioning or security of the Platform, including introducing viruses, malware, or other malicious software.

8.2. Unauthorized Access and Interference: You may not attempt to:

Access any part of the Platform, including systems or services, that you are not authorized to access;
Circumvent or bypass any security measures, encryption, or access restrictions designed to protect the Platform or its data;
Interfere with the functioning of the Platform, including by manipulating or attempting to manipulate its algorithms, systems, or services for personal gain.

8.3. Prohibited Conduct Relating to User Accounts

You may not create more than one account for the purpose of evading restrictions or to manipulate any feature or functionality of the Platform;
You must not share your account information, including usernames, passwords, or other credentials, with third parties, and you are responsible for any activity that occurs under your account;
You are prohibited from using the Platform to facilitate or participate in illegal gambling or any activities that contravene applicable laws or the Platform's intended use.

8.4. Consequences of Prohibited Conduct: If you engage in any prohibited conduct described in this Clause, FantasiaFlows reserves the right to:

Suspend or terminate your User Account;
Limit or restrict your access to the Platform;
Report your conduct to the appropriate authorities, if necessary;
Take any other action deemed appropriate under applicable laws.

8.5. Cooperation with Investigations: You agree to cooperate fully with any investigation by FantasiaFlows or law enforcement authorities into potential violations of applicable laws or these Terms. This may include providing information, records, or access to your account or communications, where legally permissible.

9. Privacy

9.1. Commitment to Privacy: We are committed to safeguarding your privacy and ensuring that any personal information you provide to us is handled in a secure and responsible manner. We will only collect, use, and disclose your personal information as described in our Privacy Policy.

Any dispute arising out of or relating to these Terms of Service shall be subject to the exclusive jurisdiction of the courts located in England and Wales.
